Sahuarita Municipal Court

Cases below were heard by Judge Maria Avilez on Nov. 17 unless otherwise noted. Information was supplied by the office of the Town Prosecutor. A substitute prosecutor, Chris Blevins, appeared in court.

Eugenio S. Olivas, 44, Sahuarita, charged with four counts of violating the town building code at his business, Sonoran Desert Off-Road, was given a pre-trial hearing date of Dec. 15. He was not present but was represented by his attorney, Ronald Newman. He has no yet entered a plea. Members of the public had complained to the town council in recent months about the business.

Brittany Shaye Naim, 19, Tucson, charged with two counts of DUI, was set for an evidentiary hearing Jan 28. She was represented by the court-appointed counsel Anna Dennis.

Elizabeth Ogus, 32, Green Valley, charged with shoplifting, took diversion, meaning a standard plea bargain in which she pleaded conditionally guilty, got a suspended fine of $268 and was ordered to pay a $75 deferred prosecution fee within a month and to complete the NASP (National Association of Shoplifting Prevention) anti-shoplifting program, which has its own cost, within three months.

Jesus Ayala, 46, Rio Rico, charged with assault, took a diversion, meaning a standard fine of $232 was suspended pending completion of an anger management class.

Peggy Agnes Lopez, 42, Sahuarita, took diversion on a charge of driving on a suspended license and on a charge of no current registration was fined $72 and ordered to show proof of current registration. Under the standard plea bargain on the suspended license charge she pleaded conditionally guilty and got a suspended fine of $562. By producing a valid license in court she can plead guilty instead to the lesser charge of driving with no license in her possession and pay a fine of $143. She was cited Oct. 31 about 12:10 a.m. near the northbound Interstate 19 on-ramp from eastbound Duval Mine Road.


Michael Anthony Marshall, 19, Sahuarita, took diversion on a charge of having alcohol in his body while under age 21. He pleaded conditionally guilty and got a fine of $232 that was suspended pending completion of alcohol education.

Tina Smith, 28, Sahuarita, declined an offer of diversion on a charge of driving on a suspended license and was set for a pre-trial hearing Dec. 8. She said she hoped to resolve the matter before the next court date.

Michael Salvador Fredrikson, 19, Sahuarita, declined an offer of diversion on a charge of possession of marijuana and was set for a pre-trial hearing Dec. 15.

Oscar Lopez, 28, Sahuarita, who was charged with no insurance, suspended license and registration and driving with only one headlight, took the plea bargain on the suspended license charge and was ordered to show proof of insurance in his name; proof of non-ownership of the vehicle in which he was cited and a repair order for the headlight. He was set for a hearing on Dec. 15.

Andrew Grant Hernandez, 18, Sahuarita, charged with contributing to the delinquency of a minor and having alcohol in his system under age 21, was set for a bench trial on Dec. 10.

On Nov. 10, Patrick Ongley, 42, Sahuarita, charged with criminal damage, was arraigned and given a pretrial hearing date of Dec. 1. He was accused of kicking and cracking the glass front door at the Radio Shack store in Sahuarita Plaza. He told police he kicked it by accident.

Matthew Latimer, 19, Green Valley, charged with disorderly conduct, was scheduled for a Dec. 1 arraignment, but on Nov. 20 the Town Prosecutor filed with the judge a motion to dismiss the charge for insufficient evidence.

Dallas Shannon Keno, 44, Sahuarita, charged with open container, won an extension until Dec. 21 to complete an alcohol education class to fulfill requirements for a diversion program.

Ryan Colby Moriarity, 19, Sahuarita, completed his diversion and had his assault case closed.

Luis Cabrera, 31, Rio Rico, charged with theft, was set for a pre-trial hearing on Dec. 15.

Desiree Andrea Knittle, 27, Sahuarita, charged with disorderly conduct, was set for a Dec. 1 pre-trial hearing.

Anthony Psomas, 20, Sahuarita, charged with possession of marijuana and drug paraphernalia, was set for a hearing Dec. 17. He was not present in court but his attorney, Geoffrey Ferlan, was there to represent him.

The following were cited for driving on a suspended license:

Raquel M. Barreras, 34, Tucson, Nov. 5 at 11:30 p.m., kilometer post 75 on Interstate 19, also speeding and no insurance.

Marco A. Collao-Chavez, 45, Sahuarita, Nov. 4 at 2:05 p.m., milepost 57 on Nogales Highway, also no splash guard on his pickup truck.

Reyna Magdelena Juarez, 31, Tucson, Nov. 4 at 1:40 p.m., at Interstate 19 at Sahuarita Road, also leaving traffic lane;

Charles F. Sommers, 40, Sahuarita, Nov 5 at 8:55 p.m., on Interstate 19;

Mark W. Steen, 31, Tucson, Nov. 5 at 2 p.m. Nogales Highway and Sahuarita Road, and

Samara Ann Whittaker, 34, Tucson, Nov. 4 at 11:10 p.m. at Sahuarita and La Villita roads, also unsafe movement.
